1.  Who We Are & Scope

 


These Terms of Use & Sale (“Terms”) are a legal agreement between Baerlane FZ-LLC, a company registered at Meydan Grandstand, 6th Floor, Al Meydan Road, Nad Al Sheba 1, Dubai, United Arab Emirates (“we,” “us,” “our”), and you. They govern your use of www.baerlane.com and any related sites/apps (the “Site”), and your purchases of our products (the “Products”).

By using the Site or purchasing Products, you confirm you are 18 years or older and agree to these Terms. If you do not agree, do not use the Site.


We sell Products globally. Nothing in these Terms removes or limits your rights under mandatory consumer protection laws in your country of residence.

 

 

 

2.  Changes to These Terms

 


We may update these Terms by posting a new version on the Site. Changes take effect upon posting unless a later effective date is stated. Your continued use means you accept the changes.

 

 

 

3.  Privacy & Communications

 


Our Privacy Policy explains how we collect and use data. By providing your email/phone, you consent to receive transactional communications (e.g., order updates). You may opt out of marketing emails/SMS via the provided methods; we may still send essential service messages.

 

 

 

4.  Using the Site

 


We grant you a limited, revocable, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

 

  • copy, scrape, or data-mine content;

  • frame, mirror, or reverse engineer the Site;

  • breach or test security systems; or

  • disrupt or overload the Site.

 


We may suspend or terminate access for violations.

 

 

 

5.  Accounts

 


You’re responsible for your account and password. Notify us promptly of any unauthorized use. We may refuse, close, or limit accounts at our discretion where permitted by law.

 

 

 

6.  Orders, Pricing & Payment

 


All orders are offers to buy. We may reject, cancel, or limit quantities (e.g., suspected reselling, stock or payment issues). Prices, taxes/duties, promotions, and availability may change without notice. You authorize our payment processor to charge your chosen payment method for the order total.

 

 

 

7.  Shipping, Title & Risk of Loss

 


We ship to the delivery address you provide. Shipping dates are estimates only. Title and risk of loss pass to you when we hand items to the carrier. We are not liable for delays outside our control. If an item is unavailable, we’ll refund you or offer options.

 

 

 

8. Returns & Refunds

Returns & Refunds Policy

At Baerlane™, your satisfaction is important to us. Please read our returns and refunds policy carefully before making a purchase:

No Returns or Exchanges: For hygiene and safety reasons, we do not accept returns or exchanges on any products once they have been shipped. All sales are final.

Damaged or Defective Items: If your order arrives damaged or defective, please notify us within 7 days of deliveryby emailing [your support email] with your order number and clear photos of the issue.

Lost Orders: If your order does not arrive within the estimated delivery timeframe, please contact us within 7 days after the delivery window has passed. We will investigate with our fulfillment partner.

Refunds: Approved refunds will be processed back to your original payment method. Refunds will reflect the amount paid (including discounts, if any). Shipping fees are non-refundable.

Exclusions: Refunds are not issued for delays outside our control (e.g., customs, courier disruptions).

Baerlane™ reserves the right to refuse refund requests that fall outside these terms.

 

 

 

9. Product Information, Safety & Regulatory

 


We work with manufacturers who follow Good Manufacturing Practices (GMP) and meet regulatory requirements in the regions where our Products are sold.

 

  • United States: Our Products are manufactured in FDA-compliant facilities. Where Products fall under categories that require registration or listing (such as OTC drug products or color additives), they are registered or listed with the U.S. Food & Drug Administration (FDA). Cosmetic products in the U.S. do not require FDA pre-approval, but must comply with the Federal Food, Drug, and Cosmetic Act.

  • Canada: Our Products are manufactured in facilities that comply with Health Canada standards. Where applicable, Products are subject to the Cosmetic Notification Form (CNF) requirements.

  • European Union & United Kingdom: Products sold in the EU/UK comply with applicable cosmetic regulations, including ingredient restrictions and labeling rules. Additional requirements, such as Responsible Person designation and Cosmetic Product Safety Reports (CPSR), are followed where legally required.

  • Other Regions: Local labeling and compliance requirements may vary by country. By purchasing our Products, you acknowledge that it is your responsibility to ensure that their use complies with the laws and regulations of your jurisdiction.

 


We strive for accuracy but do not guarantee that product descriptions, images, or colors are error-free. Always check the packaging and ingredient list before use. Discontinue use if irritation occurs and consult a healthcare professional if you have concerns, allergies, medical conditions, or are pregnant/breastfeeding.

 

 

 

10.  Subscriptions (if applicable)

 


If you enroll in auto-delivery, you authorize recurring charges at the interval you select until you cancel via your account at least 24 hours before the next charge. We may update pricing with prior notice where required by law.

 

 

 

11.  Intellectual Property

 


All Site content (text, images, logos, designs, code, “look and feel”) belongs to us or our licensors and is protected by IP laws. You may not use our trademarks without prior written permission. You may link to public pages in a fair, non-misleading way that does not imply sponsorship.

 

 

 

12.  User Content & Reviews

 


If you post reviews, photos, or other content (“User Content”), you represent you own it and it doesn’t violate rights or laws. You grant us a worldwide, royalty-free license to use, reproduce, display, and distribute your User Content for marketing, social media, and Site features. We may remove content at our discretion.

14.  Disclaimer of Warranties

 


Except as expressly stated on a Product label or required by law, the Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation). Some jurisdictions (e.g., certain U.S. states, Canadian provinces, EU/UK) do not allow limits on implied warranties; those limits may not apply to you.

 

 

 

15. Limitation of Liability

 


To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, data loss, or business interruption). Our total liability for any claim relating to a Product or the Site will not exceed the amount you paid for that Product, or USD $100 for non-purchase claims.


This does not limit liability for death or personal injury caused by negligence, fraud, or liability that cannot legally be limited. Your statutory rights remain unaffected.

 

 

 

16.  Indemnity

 


You agree to indemnify and hold us harmless from third-party claims arising out of your misuse of the Site, violation of these Terms, or infringement of others’ rights, except to the extent caused by our negligence or breach.

 

 

 

17.  Dispute Resolution — Arbitration & Class Action Waiver

 


Informal Resolution. Before filing a claim, you and we agree to try to resolve it informally by emailing legal@baerlane.com with a description of the issue and requested relief. If not resolved within 60 days, either party may proceed as below.


Binding Arbitration (U.S. & Canada). Except for small-claims matters, disputes with customers in the U.S. or Canada will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA)(U.S.) or ADR Chambers / ICDR (Canada). The arbitrator may award individual relief but may not award class-wide or public-injunctive relief. Hearings may be virtual, your county/province, or Dubai/UAE (your choice), unless consumer law requires otherwise.


Other Regions. Customers outside the U.S./Canada agree disputes will be resolved in the courts of Dubai, UAE, unless mandatory consumer law requires otherwise.


Class Action Waiver. You and we waive any right to participate in a class or representative action or class arbitration.


Opt-Out. You may opt out by emailing legal@baerlane.com within 30 days of first use or purchase, stating your name, email, and clear request to opt out.


Small Claims. Either party may bring an individual claim in small-claims court where permitted.

 

 

 

18.  Governing Law & Forum

 


These Terms are governed by the laws of the United Arab Emirates (Dubai / Meydan Free Zone), except that mandatory consumer protection laws of your residence (e.g., EU directives, U.S. states, Canadian provinces) may also apply. For disputes not subject to arbitration or small claims, the exclusive forum will be the courts of Dubai, UAE, unless consumer law requires a local forum.

  • Canada: These Terms do not limit rights under applicable provincial consumer protection statutes. Québec residents: the Consumer Protection Act (Québec) prevails in case of conflict.

  • European Union & UK: Nothing in these Terms limits non-excludable rights under EU or UK consumer law.

 

 

 

 

20.  Miscellaneous

 


If any term is unenforceable, the rest remain effective. These Terms are the entire agreement between you and us regarding the Site and Products.
